Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Food Truck Finder (Pty) Ltd ("Company," "we," "our," or "us") concerning your access to and use of the Food Truck Finder website and services (collectively, the "Services").
These Terms are compliant with:
- Consumer Protection Act, 2008 (CPA) - Protecting consumer rights in South Africa
- Electronic Communications and Transactions Act, 2002 (ECT Act) - Governing electronic transactions
- Protection of Personal Information Act, 2013 (POPIA) - Safeguarding personal data
IMPORTANT: By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use our Services. Please read these Terms carefully before using our Services.

1. Description of Services
Food Truck Finder provides an online platform that:
- Enables users to discover and search for food trucks across South Africa
- Displays food truck locations, menus, operating hours, and contact information
- Facilitates booking inquiries between customers and food truck owners
- Allows food truck owners to create, manage, and promote their business listings
- Provides interactive maps and location-based search functionality
- Offers subscription-based services for food truck owners
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, in accordance with the Consumer Protection Act.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age or have parental/guardian consent
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Services under South African law
- Provide accurate and complete registration information
For food truck owner accounts, you must additionally:
- Be a registered business owner or authorized representative
- Have all necessary licenses and permits to operate a food truck in South Africa
- Comply with applicable health, safety, and business regulations
3. User Accounts
3.1 Account Creation
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
3.2 Account Responsibilities
You are responsible for:
- All content posted and activities conducted through your account
- Ensuring your account is not used by unauthorized persons
- Complying with all applicable laws and these Terms
- Maintaining the confidentiality of your login credentials
3.3 Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading information
- Your account is used for fraudulent or illegal activities
- Payment obligations are not met
4. Food Truck Owner Obligations
If you list a food truck on our platform, you agree to:
4.1 Listing Accuracy
- Provide accurate and up-to-date information about your food truck
- Update menu items, prices, and operating hours promptly
- Maintain accurate location and availability status
- Upload current and representative photos of your food and truck
4.2 Legal Compliance
- Hold all necessary business licenses and permits
- Comply with health and safety regulations
- Maintain required insurance coverage
- Comply with Consumer Protection Act requirements
- Display accurate pricing in accordance with CPA regulations
4.3 Customer Interactions
- Respond to booking inquiries in a timely and professional manner
- Honor confirmed bookings and commitments
- Provide accurate quotes and pricing information
- Treat customers fairly and respectfully
- Handle complaints in accordance with the Consumer Protection Act
4.4 Subscription Requirements
- Maintain active subscription payments to keep listings visible
- Pay monthly subscription fees on time
- Notify us of any payment issues or billing disputes
- Understand that unpaid subscriptions may result in listing suspension
5. Subscriptions and Payment
5.1 Subscription Plans
We offer the following subscription plans for food truck owners:
Basic Plan - R299/month
- List 1 food truck with full profile
- Real-time location and status updates
- Menu and operating hours management
- Receive booking inquiries
- Basic analytics dashboard
Premium Plan - R599/month
- List up to 2 food trucks
- All Basic Plan features
- Priority listing in search results
- Featured placement on homepage
- Advanced analytics and insights
5.2 Payment Terms
- Subscriptions are billed monthly in advance
- We issue invoices at the beginning of each billing period
- Payment must be made within 7 days of invoice date via EFT
- All prices are in South African Rand (ZAR) and include VAT where applicable
- Late payments may result in service suspension
5.3 Cancellation and Refunds
In accordance with the Consumer Protection Act:
- You may cancel your subscription at any time from your dashboard
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial months or unused time
- Upon cancellation, your listing will be removed after the paid period expires
- You may request a refund within 14 days if the service is materially defective
5.4 Price Changes
- We reserve the right to modify subscription prices
- Price changes will be communicated 30 days in advance
- Existing subscribers will be given notice of price changes before renewal
- Continued use after price change constitutes acceptance
6. Prohibited Uses
You agree NOT to use our Services to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Post false, misleading, or deceptive information
- Engage in fraudulent activities or scams
- Harass, abuse, or harm other users
- Upload viruses, malware, or harmful code
- Attempt to gain unauthorized access to our systems
- Scrape, copy, or extract data without permission
- Spam users with unsolicited communications
- Impersonate another person or entity
- Interfere with the proper functioning of the Services
- Post offensive, discriminatory, or inappropriate content
- Collect personal information of other users without consent
- Use automated systems (bots) without authorization
Violation of these prohibited uses may result in immediate account termination and legal action.
7. Intellectual Property Rights
7.1 Our Intellectual Property
The Services and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, software, and design) are owned by Food Truck Finder and are protected by South African and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, or distribute our content without permission
- Modify, create derivative works, or reverse engineer our software
- Use our trademarks, logos, or branding without authorization
- Remove copyright or proprietary notices
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or business purposes in accordance with these Terms.
8. User Content and Licenses
8.1 Your Content
You retain ownership of all content you submit to the Services (photos, descriptions, menus, etc.). However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and promoting the Services.
8.2 Content Standards
All user content must:
- Be accurate and not misleading
- Not violate any laws or third-party rights
- Not contain offensive or inappropriate material
- Comply with advertising standards and regulations
- Be your original content or properly licensed
8.3 Content Moderation
We reserve the right to review, edit, or remove any user content that violates these Terms or applicable laws, without prior notice.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by South African law, we disclaim all warranties, express or implied, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties that the Services will be uninterrupted, secure, or error-free
- Warranties regarding third-party content or services
Specific Disclaimers:
- Food Truck Information: We do not guarantee the accuracy of food truck listings, menus, prices, or availability. Users should verify information directly with food truck owners.
- Third-Party Transactions: We are not a party to transactions between users and food truck owners. We do not guarantee the quality, safety, or legality of food trucks or their products.
- Health and Safety: Food truck owners are solely responsible for complying with health and safety regulations. We do not inspect or certify food trucks.
- Booking Arrangements: We facilitate booking inquiries but do not guarantee that food truck owners will fulfill bookings or that services will meet your expectations.
10. Limitation of Liability
To the maximum extent permitted by South African law (subject to the Consumer Protection Act):
WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or technical failures
- Actions or omissions of food truck owners or third parties
- Unauthorized access to or alteration of your content
- Food safety issues, illness, or injury related to food truck services
- Disputes between users and food truck owners
Our total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid us in subscription fees during the 12 months preceding the claim, or R1,000, whichever is greater.
Nothing in these Terms shall limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under South African law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Food Truck Finder, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Content you submit to the Services
- Your food truck operations (for food truck owners)
- Disputes between you and other users or third parties
12. Termination
12.1 Termination by You
You may terminate your account at any time by:
- Canceling your subscription from your dashboard
- Contacting us at noreply@foodtruckfinder.co.za
Upon termination, your access will continue until the end of your paid subscription period.
12.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Your account remains unpaid for 14 days after invoice due date
- You harm or threaten to harm other users
- We are required to do so by law
12.3 Effects of Termination
Upon termination:
- Your access to the Services will cease
- Your food truck listings will be removed (for owner accounts)
- You remain liable for any outstanding fees
- Provisions that by their nature should survive will continue (e.g., liability, indemnification)
- We may retain certain information as required by law
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal proceedings, you agree to first attempt to resolve disputes informally by contacting us at noreply@foodtruckfinder.co.za. We will work with you in good faith to resolve the issue.
13.2 Consumer Rights
Nothing in these Terms affects your rights under the Consumer Protection Act, including your right to refer disputes to:
- National Consumer Commission
- Provincial Consumer Protection Authority
- Consumer Court
- Ombud with jurisdiction
13.3 Arbitration
If informal resolution fails, disputes may be resolved through arbitration under the Arbitration Act, 1965, in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including but not limited to:
- Consumer Protection Act, 2008 (CPA)
- Electronic Communications and Transactions Act, 2002 (ECT Act)
- Protection of Personal Information Act, 2013 (POPIA)
Subject to Section 13 (Dispute Resolution), you agree to submit to the non-exclusive jurisdiction of the South African courts for the resolution of any disputes arising from or related to these Terms or the Services.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you by email (for registered users)
- Display a prominent notice on the website
- Provide at least 30 days' notice for changes affecting paid services
Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services and cancel your account.

General Provisions
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or successor entity.
Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Food Truck Finder regarding the Services.
Language
These Terms are provided in English. If translated into other languages, the English version shall prevail in case of any conflict or inconsistency.
